Tax Time

Hi everyone!

Terry informed me that I could claim him as a dependent because of the money that is sent for his account. Are any of you aware of this? I'm not a tax professional and don't use a tax service so I'm not certain how to verify this.

I am interested to see your ideas and comments on this.

I would speak with a professional before you attempt to do this...Last year I spoke with my accountant, she said that in order to claim someone you have to provide more than 50% of their support...well you know BOP, spends so much money to take care of each inmate (Ha Ha Ha)...I decided it wasn't worth the risk because in reality they are the ones providing his housing, medical and food.

I was very iffy about it when he told me. The last thing I need is tax fraud! OMG I can see it now both of us "behind the wall." I'll just let the BOP have that deduction LOL

I would say no. You have to be able to prove that you have provided him with more than 50% and he has to live with you.

From IRS publication 929 (2007)

Dependent. A person, other than the taxpayer or the taxpayer's spouse, for whom an exemption (defined later) can be claimed. To be your dependent, a person must be your qualifying child or qualifying relative (both defined later). For more information, see Exemptions for Dependents in Publication 501.


Qualifying relative. To be your dependent (defined earlier), a person must be either your qualifying child (defined earlier) or your qualifying relative. Generally, a person is your qualifying relative if that person:

Lives with or is related to you,

Does not have $3,400 or more of gross (total) income,

Is supported (generally more than 50%) by you, and

Is neither your qualifying child nor the qualifying child of anyone else.

That's what I said...my luck, I will end up in trouble and get twice as much time as he did...It's not worth it to me !
