Setup for another let down

well after nearly 6 months of waiting for Chance's hwh date...we finally got it! his counselor told him he will get between 150-180 days (5-6months hwh)...well wouldn't you know it the counselor procrastinated all this time and yesterday we found out that the counselor only put in for 90 days...and that is exactly what he got...HWH is now Sept 16th...Chance was pissed because the counselor or case manager or whoever did not put in what she was supposed to...so he took his copy of the paper with 150-180 to the warden...wish us luck on that because the warden sent him to someone over all the counselors/case managers and an email was sent to whoever in BOP to modify his hwh time...hopefully he will get more time...but if not, I guess I should just be happy we finally got a date.

sounds like a bittersweet situation....but like you said..at least you all have a date now....

What was his sentance? They can only give him 10%or 6 months which ever is less. You would have to have a 5 year sentance to get 180 days. They should have never told him 180 days.

since the second chance act they can give him more than the 10%...his case manager told him he could even put in for the 12months but that would most likely be denied since the BOP is not giving out 12 months HwH...the top guy he talked to the other day (can't remember the name) told him he will see what can be done since he still has to establish a residence he needs more hwh time...we'll see though, Im just happy to know it won't be any longer than Sept.

I know what second chance says. This is where what I have seen in monitoring the different blogs and websites

1. It has not been funded yet.
2. The BoP does not agree with increasing HWH for anyone, "not productive."

I hoestly believe that the staff at M'town likes to play mind games with the guys. I would not be surprised to find out that half the stupid rumors that start about bills and such start with the staff, just to see what happens when the guys get disappointed.

My husband has it in his sentencing papers that the judge sentenced him to 12 months bop and 12 months hwh and they are giving him a hard time too. First they said 30 days now they are saying 90-120, but we are having our attorney contact the judge and bop. Will let you know what happens. Good luck! and please let me know if you find out anything as well. Our attorney heavily researched 2nd chande prior to our sentencing, and the Judge even quoted it as well as the 12months in the PSR along with probations agreement. I know ultimattely they have the power to do what they want, but If I dont keep hope I wont have anything. I know it has not seem to have happened for anyone else yet, but it has to start sometime right? Also, since my husband was sentenced after the 2nd chance act was passed I am hoping he atleast has a shot. However, like you Melanie, I would be happy with 6 months even. Heres to hoping!

thought I would just add a little update...Chance went to the warden with a copy of his paper from the case worker or counselor ( Im not sure) stating for him to get 150-180 days...the warden took him to the head guy over the case managers, Chance's case manager called him in to apologize and sent an email with him right there to see asking for 6 months hwh...so wish us luck, if all goes well he will be going to hwh in 2 months, otherwise 5 more months to go.

Keep us up dated on this ladies. As if you get more than the 10%, that is a good sign that the BoP is flexiable and are following the Second Chance Act as we have been hoping. Remember the purpose of the Act was to make funds avaialble to non profits and HWH, the extension of HWH time is at the descretion of the BoP and not mandated by the Act.
